Abstract: The economical globalization through the liberalization of the markets and capitals boosted the economical development of the nations and the needs for sorting out the disputes arising from the foreign investment. The arbitration, for all the inherent advantages, such as swiftness, arbitrators’ specialise skills and impartiality sets a pacifier tool for the interest in account. Safeguarded the public interest, we face the problem of the confidentiality in the arbitration. The urgent development of impelling mechanisms concerning transparency, guaranty and protection of the interest in account, reveals itself urgent. Through a bibliography review, we will dense the state of art, by going through the several solutions concerning, and pointing out the most suitable. Through the jurisprudential analysis we will point out the solution for the conflict confidentiality/public interest. The transparency, inextricable from the public interest, imposes the arbitration process can be open to all citizens. Transparency rules have been considered at the UNCITRAL in attempting to conciliate the necessity of publicity and the public interest, however still insufficient. The arbitration of foreign investment carries consequences to the citizens of the State. Articulating mechanisms between the arbitral procedures secrecy and the public interest should be adopted. The arbitration of foreign investment, being a tertius genius between the international arbitration and the administrative arbitration would claim its own regulation in each and every States where the confidentiality rules and its exceptions could be identified. One should enquiry where the limit of the citizens’ individual rights protection and the public interest should give way to the principle of transparency
Abstract: In recent decade's tourism industry is one of main
reasons of the social and economical development for many
countries; so these countries try to gain more portion of it for
themselves. The excessive natural and cultural touristy potentialities
in Iran made this country to be one of the most attractive sightseeing
areas, although; Iran has got the lowest rate of tourists. Khark Island
is about 32 km. It is a beautiful coral reef coast; about 98% of oil
export has been done through this place. The ecotourism
potentialities of Khark and Kharko Islands (about 3.7km far from
Khark) are the reason to consider ecotourism and the main activity in
these islands which is exporting oil at the same time. This article
refers to way of measuring the geographical coordination of the
place, and the potentialities, ecotourism attraction of the islands and
introduces some ideas in order to expand tourism in the islands.
Abstract: Cooperative organizations in Malaysia are going
through a phase of rapid growth. They are seen by the government as
another crucial vehicle to drive and boost up the country-s
economical development and growth. Hence, the issue of cooperative
governance is of great importance. Unlike literatures on corporate
governance for public listed companies-, literatures on governance
for social enterprises, in particular the cooperative organizations are
still at the early stage in Malaysia and very scant in number. This
paper will look into current practices as well as issues and challenges
related to cooperative governance. The need for a better solution
towards forming best practices of cooperative governance framework
appears imperative in deterring cases of mismanagement and fraud.
Abstract: Transportation is of great importance in the current
life of human beings. The transportation system plays many roles,
from economical development to after-catastrophe aids such as
rescue operation in the first hours and days after an earthquake. In
after earthquakes response phase, transportation system acts as a
basis for ground operations including rescue and relief operation,
food providing for victims and etc. It is obvious that partial or
complete obstruction of this system results in the stop of these
operations. Bridges are one of the most important elements of
transportation network. Failure of a bridge, in the most optimistic
case, cuts the relation between two regions and in more developed
countries, cuts the relation of numerous regions. In this paper, to
evaluate the vulnerability and estimate the damage level of Tehran
bridges, HAZUS method, developed by Federal Emergency
Management Agency (FEMA) with the aid of National Institute of
Building Science (NIBS), is used for the first time in Iran. In this
method, to evaluate the collapse probability, fragility curves are
used. Iran is located on seismic belt and thus, it is vulnerable to
earthquakes. Thus, the study of the probability of bridge collapses, as
an important part of transportation system, during earthquakes is of
great importance. The purpose of this study is to provide fragility
curves for Gisha Bridge, one of the longest steel bridges in Tehran,
as an important lifeline element. Besides, the damage probability for
this bridge during a specific earthquake, introduced as scenario
earthquakes, is calculated. The fragility curves show that for the
considered scenario, the probability of occurrence of complete
collapse for the bridge is 8.6%.
Abstract: This article stands in the context of rural communities
in Brazil, where, like many others emerging countries, the
overwhelming increasing markets and the overcrowded cities are
leaving behind informal settlements based on obsolete agricultural
economies and techniques. The pilot project for the community of
Goiabeira reflects the attempt to imagine a development model that
privileges the actual improvement of living conditions, the education
and training, the social inclusion and participation of the dwellers of
rural communities. Through the inclusion of operative public space,
the aim is for them to become self-sustaining, encouraging the use of
local resources for appropriate architectural, ecological and energy
technologies and devices, that are efficient, affordable and foster
community participation, in the respect of the surrounding
environment.
